Is Hospital Management Software Legally Required in India?

No single law mandates that a hospital run a specific piece of software. But NABH accreditation standards, ABDM registration incentives, DPDP Act 2023 data-handling obligations, and state clinical establishment acts collectively make digital record-keeping, audit trails, and consent tracking the practical way most hospitals meet those separate legal and accreditation requirements — which is why HMS adoption has become close to universal for mid-sized hospitals even without a law naming the software itself.

Where the Real Pressure Comes From

The pressure is indirect but real: NABH assessors expect tamper-evident audit logs and verified diagnostic sign-offs that are difficult to produce reliably on paper; DPDP obligations are hard to demonstrate without a system logging every record access; and ABDM-linked empanelment increasingly assumes a digital registration and record trail exists.
